Today, Evergreen Action released “Down to the Wire: A Report Card on EPA’s Progress on 10 Important Power Sector Rules,” an updated analysis of the EPA’s progress on key power-sector rules. The report card shows that while EPA has made significant progress since Evergreen’s first report card was released in October 2022—including the recent finalization of a stronger national soot standard—only a few months remain to finalize five crucial rules before the April 2024 deadline imposed by the Congressional Review Act. The agency must ramp up the pace to finalize these rules by April.
By finalizing these 10 rules on an expedited timeline, President Joe Biden and Administrator Michael Regan can ensure that key climate and clean air promises are kept before the next election and that our climate targets remain within reach. By delaying, EPA risks leaving signature achievements unfinished.
Rules at risk include:
- Carbon Standards for New Power Plants
- Carbon Standards for Existing Power Plants
- Mercury & Air Toxics Standards
- Toxic Water Pollution Rule
- Coal Ash Rule

“EPA is making significant progress on implementing critical rules for our climate, but we are now down to the wire,” said Evergreen Action Senior Power Sector Policy Lead Charles Harper. “In order to meet President Biden’s climate targets, EPA needs to finalize these major rules in a hurry, including its carbon standards for new and existing power plants, mercury and air toxic standards, and coal ash and toxic water pollution rules. The American people want clean air and clean water, and it’s crunch time for EPA to take action to stay on track for our climate goals.”
