Evergreen: SCOTUS Must Rule to Uphold Precedent and Preserve the Clean Air Act

Following the oral arguments in West Virginia v. EPA, Evergreen Action Executive Director Jamal Raad released the following statement:

“Today, the fossil fuel industry and their lawyers showed us just how desperate they are to overturn 50 years of legal precedent for the sake of their own bottom line. The Clean Air Act prevents hundreds of thousands of premature deaths each year and has been supported by both Democrats and Republicans for decades. If corporate polluters and their right-wing allies get their way, it would gut one of America’s best tools to combat deadly pollution and climate change. By taking a case against a non-existent regulation, the conservative Supreme Court is pushing towards legislating from the bench, and further away from defending the Constitution. Giving in to the fossil fuel industry’s demands and throwing out decades of precedent in this case would be disastrous for the reputation and legitimacy of this Court. Justices must reject this dangerous path.”
